1. About us

Mortgager.com.au is operated by iAugur Pty Ltd ABN 66 677 924 373, trading as mortgager.com.au (“Mortgager”, “we”, “us” or “our”).

We provide mortgage broking and finance assistance services. Credit assistance is provided through Credit Representative Number 571369, authorised under Australian Credit Licence 389328, held by Connective Credit Services Pty Ltd.

2. Application of these terms

These terms govern your use of our website, including its information, enquiry forms, calculators and online tools.

Please read these terms before using the website. By using it after having a reasonable opportunity to read these terms, you agree to them. If you do not agree, please stop using the website. You may contact us to discuss accessing our services another way.

These terms do not constitute a loan agreement or replace our Credit Guide, Privacy Disclosure Statement and Consent, any accepted Credit Quote, credit proposal disclosures or a lender’s loan documents.

Any additional terms for a particular service will be provided before you agree to that service. Those terms govern that service to the extent of an inconsistency with these website terms, subject to applicable law.

3. Our services and obligations

We help customers identify finance options and apply for loans through lenders we are authorised and accredited to access. Mortgager is a mortgage broker and does not itself provide the loan funds or make the lender’s approval decision.

We access lenders through our aggregator, Connective Broker Services Pty Ltd. The aggregator’s panel is broader than the lenders an individual broker may be accredited to use. We do not represent that we compare every lender or product in the market.

Available options depend on our accreditations, the products available and your circumstances. We will explain relevant limitations when providing assistance.

Where applicable, we must comply with responsible lending requirements, act in your best interests when providing mortgage broking credit assistance and give your interests priority where a conflict arises. Nothing in these terms limits those obligations.

4. General information and professional advice

General website content is provided for educational and informational purposes. Articles, examples and guides do not assess your individual financial position, requirements or objectives.

General website information is not a personalised credit recommendation and does not establish that a loan is suitable for you. Individual credit assistance is provided through our assessment and assistance process.

We do not provide taxation, accounting, legal or financial planning advice. Obtain advice from an appropriately qualified professional where required before entering a loan or making a related property or financial decision.

This clause does not exclude our responsibilities for recommendations or credit assistance we actually provide.

5. Rates, fees and product information

Interest rates, fees, lending criteria, product features and promotional offers may change. Information is current only as at any date stated.

An advertised “from” rate applies only where the relevant eligibility requirements are met. Your available rate and terms depend on the lender, product and assessment of your application.

We do not guarantee the lowest market rate, a particular saving or access to every advertised product.

Read any comparison rate with its stated assumptions and warning. A comparison rate is based on a specified example and may not reflect your actual borrowing costs. Different loan amounts, terms and fees may produce different results.

We take reasonable care with published information and will correct material errors we identify. Contact us to confirm the details relevant to your proposed application.

6. Calculators, comparisons and estimates

Calculators, borrowing estimates and other automated tools provide indicative results based on your inputs and the assumptions displayed. They are not loan approval, an offer of credit or a personalised recommendation.

Actual repayments, borrowing capacity, costs and savings may differ because of lender policies, interest rate changes, fees, repayment timing and your circumstances.

Unless expressly included, a calculation may exclude costs such as lenders mortgage insurance, government charges, valuation fees, discharge fees or fixed-rate break costs.

Comparisons may not cover every product feature relevant to you. When considering refinancing, take account of switching costs and whether extending the loan term could increase total interest, even if repayments decrease.

Check your inputs and the assumptions shown, and discuss your circumstances with us before relying on a result.

7. Enquiries, applications and approval

Submitting an enquiry, completing an online form or receiving an automated response does not mean finance has been approved.

A lender may require verification of your financial circumstances, identification, property valuation and other information before making a decision.

Pre-approval or conditional approval may expire and remains subject to its stated conditions. Final approval, any loan offer and settlement are governed by the lender’s requirements and documents.

We cannot guarantee approval, a particular valuation, settlement timing or an advertised rate. Tell us about finance and settlement deadlines so we can discuss whether they may be achievable.

8. Information you provide

Please provide information that is accurate and complete to the best of your knowledge. Tell us promptly if relevant circumstances change or you identify an error.

Only provide another person’s information if you are authorised or otherwise legally entitled to do so. Do not impersonate another person or submit false or misleading documents.

Incomplete or incorrect information may delay an application or affect an assessment. This does not replace our legal duties to make reasonable enquiries and take reasonable steps to verify relevant information.

Use the secure channels we identify for identity and financial documents. Do not send passwords, PINs or one-time security codes through general enquiry forms.

9. Fees, commissions and referral arrangements

We may charge a fee for credit assistance. Where a fee applies, we will disclose it and provide any required Credit Quote for your acceptance before providing the relevant credit assistance. These website terms do not themselves impose a service fee.

Lenders and other providers may charge application, valuation, legal or other fees. Review the relevant documents before proceeding.

Our aggregator may receive upfront and ongoing trail commissions from lenders and pay commissions to us. These commissions are not separately payable by you. Relevant commission details will be disclosed in the applicable credit proposal documentation.

We may also receive permitted non-monetary benefits, such as training or professional development. Relevant benefits will be disclosed as required by law.

If someone introduces you to us, we may pay that person a referral fee or commission. Where applicable, this will be disclosed in your credit proposal documentation.

Remuneration arrangements do not displace our applicable best interests and conflict priority obligations.

10. Privacy and credit information

Our Privacy Policy explains how we collect, use, store and disclose personal information and how you can request access or correction or make a privacy complaint.

Our Privacy Disclosure Statement and Consent provides further information relevant to credit assistance, including credit reporting, lenders, our aggregator and other service providers.

We will obtain any consent or authorisation required by law before undertaking the relevant activity. Merely browsing this website or accepting these terms does not authorise us to obtain a credit report on your behalf.

These terms do not grant unrestricted rights to use or disclose your personal information or waive your privacy rights.

Where overseas processing or disclosure occurs, we remain subject to applicable Australian privacy obligations.

11. AI and automated tools

We may use artificial intelligence and automated systems to assist with activities such as document processing, extracting information, preparing summaries, comparing information with lender policies, customer support and administration.

These tools may be supplied by third-party providers. Personal information processed through them is handled subject to applicable privacy law and our privacy disclosures.

AI-assisted work used in providing credit assistance is subject to human oversight. Automated output may contain errors or omissions and does not itself constitute loan approval.

Our use of technology does not remove our responsibility for the services we provide or our applicable legal obligations.

12. Communications, marketing and cookies

When you request assistance, we may contact you using the details provided to respond to your enquiry and administer that assistance.

Using the website does not, by itself, constitute consent to unrelated marketing. We send marketing communications only where legally permitted.

You can unsubscribe from electronic marketing using the facility provided or by contacting support@mortgager.com.au. We will action requests within the applicable legal timeframe. Essential service communications may continue where appropriate.

Our Privacy Policy explains our use of cookies, analytics and advertising technologies. You can manage cookies through your browser settings and any available website controls, although disabling some cookies may affect functionality.

If we record telephone calls, we will provide any notification and obtain any consent required by applicable law.

13. Acceptable website use

You must not:

  • use the website for fraud, impersonation or other unlawful activity;
  • access accounts, systems or information without authority;
  • introduce malicious software or interfere with website security;
  • submit content that unlawfully infringes another person’s rights; or
  • use automated tools to collect personal information, bypass access controls or materially disrupt the website.

If we provide account access, take reasonable steps to protect your login details and promptly notify us of suspected unauthorised use.

14. Intellectual property

Website content, branding and software belong to us or their respective owners.

You may view, download and print content for your own lawful use in considering finance and share relevant material with your professional advisers. Keep copyright and ownership notices intact.

Unless permitted by law or the relevant owner, you must not commercially republish or sell our content or use our branding in a way that suggests endorsement or affiliation.

You retain ownership of material you submit. You allow us to use it only as reasonably necessary to handle your request, provide agreed services and meet legal obligations. Personal information remains subject to our privacy obligations.

15. External websites and providers

Our website may link to external websites, tools or services. Their operators control their content and apply their own terms and privacy practices.

A link alone does not constitute a recommendation or guarantee. Any recommendation or referral we actually provide remains subject to our applicable legal duties.

We will identify additional third-party terms that apply to a particular website feature before you use it.

16. Promotions

Cashbacks, rebates and other promotions are subject to the specific eligibility requirements, deadlines and conditions disclosed with the offer.

These terms do not independently create an entitlement to a promotional benefit. Changes to these terms will not retrospectively remove a benefit you have already earned under an applicable offer.

17. Website availability and your rights

We take reasonable steps to maintain website availability and security, but cannot promise uninterrupted or error-free access. Contact us by telephone or email if an outage affects a time-sensitive enquiry.

Nothing in these terms excludes, restricts or modifies any right, remedy, guarantee or obligation that cannot lawfully be excluded, restricted or modified.

We remain responsible for our conduct, including negligence, misleading conduct and breaches of applicable legal duties.

We are not responsible for loss to the extent it is caused by your unlawful use of the website or an event for which we are not legally responsible. This does not exclude responsibility for our acts or omissions that cause or contribute to the loss.

18. Restricting access and changing these terms

We may reasonably restrict website access where necessary to address security threats, prevent unlawful use, comply with law or respond to a material breach of these terms.

Restrictions will be proportionate. Where practicable, we will explain the reason and allow an opportunity to address the issue. Immediate action may be necessary for legal or security reasons.

Restricting website access does not remove existing contractual or statutory rights or prevent you from making a complaint.

We may update these terms to reflect changes in our website, services or legal requirements. We will publish the updated version and its effective date.

For material changes affecting continuing website services, we will provide reasonable advance notice, except where an urgent legal or security requirement requires earlier action. Changes apply prospectively and do not retrospectively alter accrued rights, agreed fees or separate agreements.

19. Complaints and dispute resolution

You can make a complaint verbally or in writing. There is no charge, and you do not need to use a particular form.

We will acknowledge and handle complaints fairly and in accordance with applicable internal dispute resolution requirements. For most credit assistance complaints, a response is required within 30 calendar days. Any applicable shorter timeframe will be followed. If a permitted delay occurs, we will explain it and provide information about external dispute resolution.

If you are dissatisfied with the response or your complaint has not been resolved within the applicable timeframe, you may refer an eligible complaint to:

Australian Financial Complaints Authority (AFCA)

AFCA provides free, independent dispute resolution for eligible complaints. Its jurisdiction and time limits apply.

Privacy complaints may also be referred to the Office of the Australian Information Commissioner through https://www.oaic.gov.au.

Nothing in these terms requires you to exhaust additional internal escalation steps before exercising a right to contact AFCA, a regulator or a court.

20. Governing law

These terms are governed by the laws of Victoria and applicable Commonwealth laws.

You and Mortgager submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. This does not limit any mandatory protection under the laws of another state or territory, or any right to bring proceedings in another competent court or tribunal.

If a provision is unlawful or unenforceable, it is ineffective to that extent. The remaining provisions continue to apply where they can operate independently.
